Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Process Intelligence Partner LLC, a Florida limited liability company doing business as "Linked By Six" ("Company," "we," "us," or "our"), governing your access to and use of the Linked By Six mobile application, website at linkedbysix.com, and all related services (collectively, the "Platform" or "Service").

BY CREATING AN ACCOUNT, ACCESSING, OR USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE PLATFORM.

These Terms include a binding arbitration provision and class action waiver in Section 18, which affect your legal rights regarding dispute resolution. Please read them carefully.

1. Eligibility

1.1 Age Requirement

You must be at least eighteen (18) years of age to create an account or use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

1.2 Business Representation

If you are using the Platform on behalf of a business entity, you represent and warrant that you have the authority to bind that entity to these Terms, and all references to "you" shall include both you individually and the business entity.

1.3 Geographic Availability

The Platform is intended for use within the United States. Users accessing the Platform from outside the United States do so at their own risk and are responsible for compliance with local laws.

You may not use the Platform if:

2. Account Registration and Security

2.1 Account Creation

To access certain features of the Platform, you must create an account by providing accurate, current, and complete information, including full legal name, valid email address, phone number (U.S. format), profile photograph (optional), and geographic location information.

2.2 Verification

We may require verification of your identity through phone number verification via OTP sent via SMS, email verification, access code validation, and business claim code validation (for Business Users).

2.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials, all activities that occur under your account, immediately notifying us of any unauthorized use, and using strong, unique passwords.

2.4 Session Management

For your security, your account session will automatically expire after sixty (60) minutes of inactivity. You will receive a warning sixty (60) seconds before automatic logout.

2.5 One Account Per Person

Each individual may maintain only one Consumer Account. Business Users may be associated with multiple Business Profiles as employees but may only own or manage one primary Business Profile unless otherwise authorized.

3. Platform Description and Services

3.1 Platform Purpose

Linked By Six is a relationship-based networking platform that connects consumers with local service businesses through verified professional networks. The Platform facilitates business discovery through personal and professional connections, direct communication, relationship-based referrals and networking, lead generation and management, and professional network visualization.

3.2 Core Features

3.3 Service Availability

We strive to maintain Platform availability but do not guarantee uninterrupted access. The Platform may be unavailable due to scheduled maintenance, emergency repairs, force majeure events, or technical difficulties beyond our reasonable control.

4. User Types and Account Categories

4.1 Consumer Accounts

Consumer accounts are free of charge and allow users to browse and search for businesses, view connection paths, send messages, make voice calls, manage personal connections, and add reviews and ratings.

4.2 Business Accounts

Business accounts require a paid subscription and provide business profile creation and management, lead inbox and management tools, business analytics and insights, employee account management, enhanced visibility in search results, and access to network reach metrics.

4.3 Employee Accounts

Business owners may add employee accounts subject to subscription tier limits. Employees are associated with the parent Business Profile, have access to business messaging and lead management, contribute to the business's network reach, and are subject to these Terms.

4.4 Preset/Claimed Business Profiles

We may create preset business profiles based on publicly available information. These profiles remain inactive until claimed by an authorized representative, may be claimed using a valid claim code, require subscription activation upon claiming, and become subject to full Business Account terms once claimed.

5. Subscriptions, Payments, and Billing

5.1 Subscription Plans

Business Users must subscribe to a paid plan to access business features. Available plans include Free Business, Growth Plan, Enterprise Plan, and Add-on Services.

5.2 Payment Processing

All payments are processed through Stripe, Inc. ("Stripe"). By subscribing, you agree to Stripe's terms of service. We do not store complete credit card information on our servers.

5.3 Billing Cycle

Subscriptions are billed on a recurring basis (monthly or annually, as selected). Your subscription will automatically renew at the end of each billing period unless cancelled.

5.4 Automatic Renewal

YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE THEN-CURRENT RATE UNLESS YOU CANCEL BEFORE THE END OF THE CURRENT BILLING PERIOD. You authorize us to charge the payment method on file for all recurring fees.

5.5 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. Upon cancellation your profile will remain visible, business features will be disabled, your data will be retained, and no refund will be issued for the current billing period.

5.6 Refund Policy

Refunds are processed in accordance with Apple App Store and Google Play Store policies.

Refund requests within 14 days: If you are not satisfied, you may request a refund within 14 days of purchase by contacting support@linkedbysix.com.

Refunds after 14 days: Evaluated on a case-by-case basis.

App Store purchases: Refund requests must be submitted through the respective app store.

5.7 Price Changes

We reserve the right to modify subscription pricing with at least thirty (30) days' notice.

5.8 Failed Payments

If a payment fails, we may retry the payment method, suspend business features, downgrade your account, or terminate your subscription after repeated failures.

6. Claim Codes and Access Codes

6.1 Access Codes

Access codes are six-character alphanumeric codes that may be required to complete registration. They are single-use and non-transferable.

6.2 Claim Codes

Claim codes allow authorized representatives to claim preset business profiles. They are unique to specific business profiles, may have expiration dates, are single-use, and require subscription activation.

6.3 Claim Code Expiration

Expired claim codes cannot be reused, but a new code may be issued upon request.

6.4 Unauthorized Use

Using codes not issued to you or attempting to circumvent the code system is prohibited and may result in account termination.

7. User Conduct and Prohibited Activities

7.1 General Conduct Standards

You agree to use the Platform in a lawful, ethical, and respectful manner.

7.2 Prohibited Activities

Misrepresentation and Fraud: Creating false accounts, impersonation, claiming unauthorized business profiles, fake reviews, or deceptive practices.

Harmful Content and Behavior: Harassment, defamatory or obscene content, transmitting malware, spam, or solicitation.

Platform Abuse: Unauthorized access, automated tools or scrapers, circumventing security features, interfering with Platform functioning, or reverse engineering.

Commercial Violations: Unauthorized commercial use, reselling access, using business features without subscription, or competing using Platform data.

Legal Violations: Violating laws, facilitating illegal activities, infringing intellectual property, or violating privacy laws.

7.3 Reporting Violations

Users may report violations through the Platform's flagging system. We investigate all reports and take appropriate action.

8. Prohibited Industries and Business Types

Adult entertainment and other businesses posing reputational, legal, or safety concerns require manual approval. Contact legal@linkedbysix.com for approval.

8.3 Right to Refuse

We reserve the right to refuse service to any business at our sole discretion.

8.4 Removal

Businesses in prohibited categories may be immediately suspended or terminated without refund.

9. User-Generated Content

9.1 Content You Create

"User Content" includes profile information, photographs, business descriptions, logos, messages, communications, reviews, ratings, and connection information.

9.2 Content Ownership

You retain ownership of your User Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and promoting the Platform.

9.3 Content Representations

By submitting User Content, you represent that you own or have the right to submit it, it does not violate third-party rights, it is accurate and not misleading, and it complies with these Terms and applicable laws.

9.4 Content Removal

We reserve the right to remove any User Content that violates these Terms without prior notice.

9.5 Reviews and Ratings

Reviews must be honest, accurate, and based on genuine experiences. Fake, purchased, competitor, or incentivized (undisclosed) reviews are prohibited.

10. Intellectual Property Rights

10.1 Platform Ownership

The Platform, including its design, features, functionality, code, graphics, logos, and all content created by us, is owned by Process Intelligence Partner LLC and protected by intellectual property laws.

10.2 Trademarks

"Linked By Six," "Six Degrees," and associated logos and designs are trademarks of Process Intelligence Partner LLC.

10.3 License to Use Platform

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform.

10.4 Restrictions

You may not copy, modify, or create derivative works; sell, license, or distribute; remove proprietary notices; or use our marks without authorization.

10.5 Feedback

If you provide feedback or suggestions, you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use such Feedback for any purpose.

11. Privacy and Data Collection

11.1 Privacy Policy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11.2 Data We Collect

We collect account information, business information, usage information, and connection information. See our Privacy Policy for full details.

11.3 How We Use Data

We use collected data to provide and improve the Platform, process transactions, facilitate connections, send notifications, analyze usage, enforce these Terms, and comply with legal obligations.

11.4 Data Retention

We retain your data for as long as your account is active or as needed to provide services, comply with legal obligations, resolve disputes, and enforce agreements.

12. Contact Synchronization

12.1 Contact Access Permission

The Platform may request permission to access your device's contact list. This permission is optional but enables enhanced connection features.

12.2 What We Access

When you grant contact access, we may collect contact names and phone numbers (normalized to U.S. 10-digit format). We do not access email addresses, physical addresses, or other contact fields.

12.3 Sync Options

12.4 How Contact Data Is Used

Imported contacts are used to identify potential connections, suggest new connections, build your network map, and facilitate introductions and referrals.

12.5 Contact Blocking

You may block specific contacts. Blocked contacts will not see you in suggestions, cannot view your profile, and cannot message or call you through the Platform.

13. Communications and Messaging

13.1 Platform Messaging

All messages are stored on our servers, subject to these Terms, and potentially reviewable for safety and compliance purposes.

13.2 Message Content

Messages may include text, emoji, file attachments, and links. You are solely responsible for the content of your messages.

13.3 Message Retention

Messages are retained indefinitely unless a conversation is archived.

13.4 Email Communications

By creating an account, you consent to receive transactional emails and marketing emails. You may opt out of marketing emails at any time.

13.5 Push Notifications

You may customize notification preferences, including quiet hours, through the Platform settings.

13.6 SMS Communications

We may send SMS for OTP verification and critical security alerts. Standard messaging rates may apply.

14. Voice Calls

14.1 Voice Call Technology

The Platform enables voice calls using WebRTC technology. Calls are peer-to-peer when possible.

14.2 No Call Recording

We do not record voice call audio. We only store call metadata (participants, times, duration, status).

14.3 Call Quality

Call quality depends on your internet connection and device capabilities. We do not guarantee call quality or availability.

14.4 Emergency Calls

THE PLATFORM IS NOT A REPLACEMENT FOR TRADITIONAL TELEPHONE SERVICE AND CANNOT BE USED TO MAKE EMERGENCY CALLS (911). You must maintain alternative means of making emergency calls.

15. Third-Party Services and Integrations

Your use of third-party services is subject to their respective terms of service and privacy policies.

15.3 External Links

The Platform may contain links to external websites. We do not endorse and are not responsible for external content.

15.4 Third-Party Content

Files, links, and content shared through messages are the responsibility of the users who share them.

16. Artificial Intelligence Features

16.1 AI-Powered Features

16.2 AI Limitations

AI features may not always produce accurate or complete results. You should review and verify AI-generated content before publishing.

16.3 AI Content Ownership

Content generated by AI features on your behalf is treated as User Content, subject to the licensing terms in Section 9.

16.4 AI Data Usage

Interactions with AI features may be used to improve AI capabilities and Platform functionality, in accordance with our Privacy Policy.

17. Content Moderation and Enforcement

17.1 User Reporting

Users may flag content or report violations through the built-in reporting system, including harassment, spam, inappropriate content, solicitation, fraud, fake reviews, and other violations.

17.2 Investigation

We investigate reported content and may take action including warnings, content removal, feature suspension, account termination, or reporting to law enforcement.

17.3 Appeal Process

Users may appeal by contacting legal@linkedbysix.com.

17.4 No Obligation to Monitor

We are not obligated to monitor all content but reserve the right to do so.

18. Dispute Resolution and Arbitration

18.1 Informal Resolution

Before initiating formal dispute resolution, you agree to contact us at legal@linkedbysix.com to attempt informal resolution within thirty (30) days.

18.2 Binding Arbitration

ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL BE RESOLVED BY BINDING ARBITRATION, except for claims that qualify for small claims court.

18.3 Arbitration Rules

Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, conducted in English, with the seat of arbitration in Florida.

18.4 Arbitration Costs

Each party shall bear its own costs. If you cannot afford arbitration fees, we will consider paying your share upon request.

18.5 Class Action Waiver

YOU AND COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

18.6 Exceptions

This arbitration agreement does not preclude you from bringing issues to federal, state, or local agencies.

18.7 Opt-Out

You may opt out by sending written notice to legal@linkedbysix.com within thirty (30) days of first accepting these Terms.

18.8 Survival

This arbitration agreement survives termination of your account and these Terms.

19. Disclaimer of Warranties

19.1 "As Is" Provision

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy of content, uninterrupted operation, and security of data transmission.

19.2 No Guarantee of Results

We do not guarantee any specific results including number of connections or leads, business revenue, quality of connections, or accuracy of business information.

19.3 Third-Party Content

We do not warrant the accuracy, completeness, or reliability of any User Content or third-party content.

19.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the above exclusions may not apply to the extent prohibited by law.

20. Limitation of Liability

20.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL COMPANY BE LIABLE FOR: indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, or business opportunities; cost of substitute services; personal injury or property damage; unauthorized access to or alteration of your data; or any third-party conduct on the Platform.

20.2 Liability Cap

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: the total fees you paid in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100).

20.3 Essential Purpose

These limitations apply even if any limited remedy fails of its essential purpose.

20.4 Jurisdictional Limitations

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. Our liability shall be limited to the maximum extent permitted by law.

21. Indemnification

21.1 Your Indemnification Obligations

You agree to indemnify, defend, and hold harmless Process Intelligence Partner LLC from and against any claims, liabilities, damages, losses, costs, and expenses arising from your use of the Platform, your violation of these Terms, your violation of third-party rights, your User Content, or your negligence or willful misconduct.

21.2 Defense and Settlement

We reserve the right to assume exclusive defense and control of any matter subject to indemnification.

22. Account Deactivation and Termination

22.1 Your Right to Deactivate

You may deactivate your account at any time through account settings. Deactivation hides your profile, retains your data for potential reactivation, and does not remove you from network relationship mapping.

22.2 Reactivation

You may reactivate a deactivated account by logging in with your credentials.

22.3 Our Right to Terminate

We may suspend or terminate your account for violation of Terms, fraudulent or illegal activity, non-payment, extended inactivity, law enforcement requests, or Platform discontinuation.

22.4 Effects of Termination

Upon termination: access is immediately revoked, active subscriptions are cancelled without refund, your profile is removed from public view, and data may be retained as required by law.

22.5 Data After Termination

We are not obligated to delete your data upon termination. Relationship mapping data may be retained to maintain network integrity for other users.

23. Modifications to Terms

23.1 Right to Modify

We reserve the right to modify these Terms at any time with at least thirty (30) days' notice via email, in-app notification, or prominent posting.

23.2 Acceptance of Changes

Your continued use of the Platform after the effective date of modified Terms constitutes acceptance.

23.3 Review of Terms

We encourage you to periodically review these Terms.

24. General Provisions

24.1 Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law provisions.

24.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Company regarding the Platform.

24.3 Severability

If any provision is found unenforceable, the remaining provisions remain in full force and effect.

24.4 Waiver

Our failure to enforce any right shall not constitute a waiver of such right.

24.5 Assignment

You may not assign your rights without our consent. We may assign our rights without restriction.

24.6 Force Majeure

We shall not be liable for failure to perform due to causes beyond our reasonable control.

Section headings are for convenience only. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship. These Terms do not create any third-party beneficiary rights. Notices to us must be sent to legal@linkedbysix.com.

BY USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
